NATO has been tracking FDA’s recent administrative and enforcement actions, and below are the disposable vapor brands cited as unauthorized or illegally sold in FDA civil money penalty complaints, import alerts, and warning letters. Please note that just because a brand is identified below does not necessarily mean that all SKUs in that brand family have been cited in an FDA administrative or enforcement action. We strongly recommend that all retailers check with their suppliers to ascertain the status of each individual product. We further note that the fact that a brand is included in the below list does not constitute any commentary on (i) the status of other non-vape categories of tobacco products that may bear the same or similar brand names or (ii) the validity of FDA’s allegations in the civil money penalty complaint, import alert, or warning letter.

Disclaimer: The brands in this table include flavored disposable vapor products that have been cited as unauthorized or illegally sold in FDA warning letters, civil money penalties, or import alerts. This is not an exhaustive list and does not cover unauthorized or illegally sold pod-based or e-liquid products also cited by the FDA. Most FDA actions cite specific flavored disposable products, not entire brands, and we do not represent that all products sold under these brands are unauthorized or illegal.

* In December 2024, FDA modified its approach to import alerts for vapor products by replacing lists of specific brands that cannot be allowed entry with a general category of products that can be allowed entry through the ports. This resulted in the removal of all specifically named vapor brands from FDA’s import alerts. Accordingly, NATO has removed the import alert column from the table above. However, we have retained five brands in the table (Aroma King, Clickmate, IPLAY Max, Juicy Bar, St!k) that were previously listed in FDA’s import alerts. We believe that these five brands, identified by asterisks, still qualify as brands that FDA has cited as misbranded and adulterated because their removal from import alerts was the result of an update to FDA’s general approach rather than any reconsideration of the previously listed brands.
